HealthHosts Terms of Service

Please read these Terms of Service (“Terms”) carefully before purchasing or using any services provided under the HealthHosts brand, operated by Webspeed Ltd (“we”, “us”, “our”).
By purchasing or using our services, you agree to be bound by these Terms.
1. Services
HealthHosts provides managed website design, hosting, maintenance, and related digital services.
All services are provided on a subscription basis unless otherwise agreed in writing.
We operate a managed hosting environment. Administrative access to hosting infrastructure and certain system-level WordPress controls may be restricted to protect security, stability, and performance.
2. Minimum Term
For new website builds, a minimum term of 3 months applies from the date the website goes live unless otherwise agreed in writing.
Cancellation within the minimum term does not waive payment obligations for the remainder of that term.
3. Subscriptions & Billing
3.1 Billing Cycle
Subscriptions are billed monthly in advance unless otherwise agreed.
3.2 Automatic Renewal
Subscriptions renew automatically at the end of each billing cycle.
3.3 Payment Methods
You must provide valid and accurate payment details. By submitting payment information, you authorise us to charge all applicable fees.
3.4 Failed Payments
If payment fails:
- We may issue an invoice requiring manual payment.
- If payment remains outstanding for 7 days after the due date, we reserve the right to suspend hosting, email services, and related services.
- Continued non-payment may result in termination and removal of the website.
4. Cancellation & Notice
Cancellation must be submitted in writing via email or our official cancellation process.
A minimum of 30 days’ notice is required.
- Services remain active until the end of the notice period.
- No partial refunds are provided.
- Setup fees and build fees are non-refundable once work has commenced.
Upon cancellation, your website and associated services will be removed from our servers at the end of your notice period unless otherwise agreed.
5. Buyout Option
Where a buyout option is offered and purchased:
- The client may acquire a licence to use the website design externally.
- The buyout applies only to the agreed design build and does not include proprietary frameworks, licensed plugins, premium third-party software, or hosting infrastructure.
- Migration assistance may incur an additional fee.
- Ongoing support, maintenance, and hosting are not included after buyout unless separately agreed.
The buyout fee must be paid in full before any transfer process begins.
6. Refund Policy
Setup fees, build fees, and completed service work are non-refundable.
Subscription refunds may be considered at our discretion but are not guaranteed.
Your statutory rights under the Consumer Rights Act 2015 remain unaffected.
7. Website Hosting & Themes
7.1 Attribution
Hosted websites must retain the “Crafted with care by HealthHosts” footer attribution unless otherwise agreed in writing.
7.2 Theme Ownership
All themes, frameworks, and proprietary code developed by Webspeed Ltd remain our intellectual property.
Clients retain ownership of their original content (text, images, media).
7.3 Licence
Clients are granted a non-exclusive, non-transferable licence to use our themes only within our hosting environment unless a buyout has been completed.
7.4 Hosting Restriction
Our themes and managed website builds may not be transferred to external hosting providers unless a buyout has been agreed and completed.
7.5 Termination of Licence
Upon cancellation or termination of services, the licence to use our theme and proprietary framework ends automatically unless a buyout has been completed.
8. Exit & Data Requests
Clients may request a copy of their website content database and uploaded media files upon cancellation.
We reserve the right to charge a reasonable administrative fee for preparing and supplying this data.
We are not required to provide proprietary theme files, licensed plugins, or platform-specific configurations.
9. Backups & Data Responsibility
We perform regular backups as part of our managed service. However:
- Clients remain responsible for maintaining independent backups of critical content.
- We are not liable for data loss, corruption, or restoration failure.
10. Client Responsibilities
You agree:
- To provide accurate information.
- Not to share login credentials irresponsibly.
- To use strong passwords.
- To ensure your website content complies with UK law and relevant professional regulations.
- Not to upload unlawful, defamatory, hateful, obscene, or malicious material.
You are responsible for ensuring your website content complies with advertising standards and professional body requirements applicable to your profession.
11. Third-Party Services
Our services may rely on third-party providers including (but not limited to): WordPress, plugin developers, payment processors (e.g. Stripe, GoCardless), email providers, and search engines.
We are not responsible for downtime, service interruptions, pricing changes, policy changes, technical failures, or platform suspensions arising from third-party services.
12. SEO & Marketing Disclaimer
Where SEO or marketing services are provided:
- We do not guarantee search engine rankings.
- We do not guarantee traffic levels or lead generation.
- Results depend on external factors outside our control.
13. Email Services
Where email services are provided:
- We do not guarantee inbox placement.
- We are not responsible for email filtering decisions made by external providers.
- You are responsible for lawful email usage and compliance with data protection laws.
14. Third-Party Modifications
If you or a third party modifies your website and causes damage:
- Repair work will be billed at £50 + VAT per hour (1-hour minimum), unless covered by your care plan.
Unauthorised modifications may void support eligibility.
15. Refusal or Termination of Service
We reserve the right to suspend or terminate services where:
- These Terms are breached
- Content violates UK law
- Payment is not received
- Activity causes reputational or legal risk
16. Fee Changes
We may update pricing. Any changes will take effect at the end of the current billing cycle.
Continued use of services constitutes acceptance of updated fees.
17. Limitation of Liability
Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot legally be excluded under UK law
Subject to the above:
- Our total liability shall not exceed the total fees paid by you in the preceding 12 months.
- We shall not be liable for indirect, consequential, special, or economic loss including loss of profit, data, goodwill, business interruption, or reputation.
Services are provided on an “AS IS” and “AS AVAILABLE” basis.
18. Indemnity
You agree to indemnify and hold harmless Webspeed Ltd against claims arising from:
- Your website content
- Your misuse of services
- Breach of these Terms
- Legal or regulatory complaints relating to your content
19. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
20. Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will provide reasonable notice.
Continued use of services constitutes acceptance of the revised Terms.
21. Privacy & Cookies
Our Privacy Policy and Cookie Policy form part of these Terms and should be read alongside them.

- Our themes stay with us unless you buy out: our custom themes/framework are part of our managed platform, but if you purchase a buyout we’ll agree what can be transferred.
